DES MOINES, Iowa — The Polk County Attorney’s Office announced on Thursday that it would not be filing charges against the Des Moines officers who shot and killed a suspect in January.
On the evening of January 2nd, Des Moines officers responded to the 2100 block of Meadow Court to investigate a report of a wanted person inside a home. According to the Des Moines Police Department, the person -identified as 32-year-old Charquan Hargrove – was wanted for Domestic Abuse Assault 3rd Offense and Probation Violation Offenses.
The Polk County Attorney’s Office on Thursday released more information about the shooting.
Before the responding officers -identified as officers Nicholas Rude, Brian Stern, and Destiny McGinnis – entered the home they located a black Jaguar parked out front, which was known to belong to Hargrove, according to the attorney’s office. Officer Rude also looked through a window and saw a man who appeared to be Hargrove inside.
The officers knocked on the door and and an adult woman answered. When officers informed her they were looking for Hargrove she claimed that Hargrove wasn’t there, and that it was just her and her kids, the attorney’s office said.
While officers were speaking with the woman Hargrove was seen on body camera video moving from one bedroom into another. Officers yelled at Hargrove to stop and ordered him to show his hands. According to the attorney’s office, the officers ordered Hargrove to show his hands multiple times before he told the officers to back up and fired at them. Officers Rude and Stern returned fire.
According to the attorney’s office, the woman ran into the room that Officer Rude was taking cover in because her infant child was sleeping in there. Shortly after Hargrove ran into the room armed with a gun, and officers Rude and Stern fired at him again.
Despite lifesaving measures, Hargrove died from his injuries.
The Polk County Attorney’s Office said it would not be filing charges because it was reasonable for the officers to believe their lives, as well as the lives of the others inside the home, were in danger, and that the use of deadly force was justified.
